A Guatemalan national previously convicted of second degree sexual assault in Rhode Island and deported in 2014 was sentenced in federal court for illegally reentering the United States and failing to register as a sex offender. The announcement was made by Acting United States Attorney Sara Miron Bloom.
According to court records, Nelson Leonel Yocute Samayoa, also known as Marvin Gomez, returned to the United States after his deportation and lived in Newport for about nine years without registering as a sex offender, which was required under his 2014 sentence.
Yocute has been held in federal custody since June 23, 2025. U.S. District Court Judge Mary S. McElroy sentenced him to time served and five years of supervised release. He remains in federal custody pending deportation proceedings.
The case was prosecuted by Assistant United States Attorney Denise M. Barton. The investigation involved the Newport Police Department, Homeland Security Investigations, and the United States Marshals Service.
“This case is part of Operation Take Back America a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).”
